Terms of service

These Terms of Service ("Terms") govern your use of rookieroom.store (the "Site") and any purchase you make from it. The Site is operated by Rookie Room, 18 Sledmere Street, Christchurch, New Zealand ("we", "us"). By using the Site or placing an order, you agree to these Terms, our Shipping Policy, Refund and Returns Policy, and Privacy Policy. If you don't agree, please don't use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. Orders for children must be placed by a parent, guardian or other adult.

2. Our products

We sell personalised LED jersey lights, made to order with the name, number, sport and size you choose. We try to describe and show our products accurately. However:

  • the live preview shows the layout and style of your light, not an exact photograph of the finished product;
  • colours, glow and brightness can look different depending on your screen and room lighting;
  • product photos may include props and room settings that aren't included; and
  • measurements are approximate and may vary slightly between production batches.

3. Personalisation and your content

You're responsible for the accuracy of the name, number and other details you enter, including spelling, capital letters and numbers. We make your light exactly as entered.

By submitting personalisation, you confirm that:

  • you're allowed to use the name and number you provide;
  • it doesn't infringe anyone else's trademark, copyright or other rights (for example, a professional team's name or logo); and
  • it isn't offensive, hateful, obscene or unlawful.

We may refuse or cancel any order whose personalisation we reasonably believe breaks these rules. If we do, we'll refund you in full.

4. Prices and payment

All prices are in US dollars (USD). Shipping to the United States is free. Applicable taxes are calculated and shown at checkout.

We may change prices at any time, but changes won't affect orders already confirmed. If a product is listed at an obviously incorrect price because of an error, we may cancel the order and refund you in full, even after you've received an order confirmation.

Payment is taken when you place your order. By submitting payment details, you confirm you're authorised to use that payment method.

5. Orders

Your order is an offer to buy. A contract is formed when we email you an order confirmation. We may refuse or cancel an order, and refund you in full, if:

  • the product or option is unavailable;
  • there's a pricing or description error;
  • we suspect fraud or unauthorised use of a payment method; or
  • the personalisation breaks section 3.

You can cancel or change your order within 12 hours of placing it, as set out in our Refund and Returns Policy.

6. Discount codes

Discount codes have no cash value, can't be combined unless we say so, and may have conditions such as minimum quantities or expiry dates. We may withdraw a code at any time. A code applied to an order that doesn't meet its conditions may be removed.

7. Shipping, title and risk

Delivery times and terms are set out in our Shipping Policy. Ownership of your product and the risk of loss pass to you when it's delivered to your shipping address.

8. Returns, refunds and remakes

Because our products are personalised, we don't accept returns for change of mind. If your product arrives damaged or faulty, or doesn't match your order, we'll remake it free as set out in our Refund and Returns Policy.

9. Product safety and use

Our lights are decorative products for indoor use only. Please:

  • use only the power cord and supply provided;
  • keep cords out of reach of babies and young children, and don't let children play with the cord;
  • don't expose the light to water or moisture, or cover it while it's switched on; and
  • switch it off and unplug it if it's damaged, and contact us.

We're not responsible for damage or injury caused by misuse, alteration, or failure to follow these instructions.

10. Intellectual property

All content on the Site, including text, graphics, photos, the Rookie Room name and logo, and the Site's design and code, belongs to us or our licensors and is protected by intellectual property laws. You may not copy, reproduce or use it for commercial purposes without our written permission.

11. Reviews, photos and feedback

If you send us a review, photo or feedback, you confirm it's genuine and that you have the right to share it. You give us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it on our Site and social media, in connection with our business. We'll never publish a child's photo without your express permission. We won't edit reviews in a way that changes their meaning, and we don't publish fake reviews.

12. Acceptable use

You agree not to:

  • use the Site for any unlawful purpose or fraudulent order;
  • interfere with the Site's security or operation, or try to access it in an unauthorised way;
  • use bots, scrapers or similar tools to collect data from the Site; or
  • impersonate anyone or give false information.

13. Third-party services

The Site runs on Shopify, and payments are processed by third-party payment providers. Your use of those services may also be governed by their own terms. We're not responsible for third-party websites linked from the Site.

14. Disclaimer

Except as stated in these Terms and our policies, and to the extent permitted by law, the Site and products are provided "as is" and "as available". We don't guarantee that the Site will be uninterrupted or error-free.

Nothing in these Terms excludes, restricts or modifies any warranty, guarantee, right or remedy that you have under consumer protection law which can't lawfully be excluded, including implied warranties that apply under the laws of your US state.

15. Limitation of liability

To the extent permitted by law:

  • our total liability for any claim relating to an order is limited to the amount you paid for that order; and
  • we're not liable for any indirect, incidental, special or consequential loss, or loss of profit, data or opportunity.

These limits don't apply to liability that can't be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.

16. Indemnity

To the extent permitted by law, you agree to indemnify us against claims, losses and costs arising from your breach of these Terms or from personalisation content you submit that infringes another person's rights.

17. Governing law and disputes

These Terms are governed by the laws of New Zealand. This doesn't take away any protection you have under the mandatory consumer protection laws of the US state where you live, and you may bring a claim in the courts where you live if those laws allow.

18. Changes to these Terms

We may update these Terms from time to time. The version on the Site when you place an order applies to that order. We'll change the "Last updated" date when we make changes.

19. General

If any part of these Terms is found to be invalid or unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms isn't a waiver of our right to do so later. These Terms, together with our Shipping Policy, Refund and Returns Policy and Privacy Policy, are the entire agreement between you and us about your use of the Site and your purchases.
